Welcome to SuperhotGeo. These Terms of Use ("Terms") are a binding agreement between you and Family Farms Forever LLC, doing business as SuperhotGeo (together with any affiliates, agents, and contributors, "SuperhotGeo," "Company," "we," "us," or "our"), governing your access to and use of the website superhotgeo.com and the SuperhotGeo mobile application, together with all content, tools, calculators, directories, and features made available through them (collectively, the "Services"). SuperhotGeo is developed and published by Family Farms Forever LLC. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Informational purpose only
The Services are provided for general informational and educational purposes about geothermal energy and related topics. Nothing on the Services constitutes professional, engineering, scientific, financial, investment, legal, tax, or other advice, and nothing on the Services should be relied upon as such. To the fullest extent permitted by law, you hereby release, waive, and discharge SuperhotGeo and Ryan Breitenbach, and our affiliates, contributors, and agents, from any and all claims, demands, damages, losses, liabilities, and causes of action of any kind — whether known or unknown — arising out of or relating to (a) your access to or use of (or inability to use) the Services; (b) any statement, content, data, estimate, or information on or made available through the Services; (c) any action or decision you take based on the Services, including any investment, financial, or business decision; (d) any incorrect, inaccurate, incomplete, or outdated information; and (e) the development, operation, availability, or discontinuation of the Services.
5. Limitation of liability
To the fullest extent permitted by applicable law, in no event will SuperhotGeo or Ryan Breitenbach, or our affiliates, contributors, or agents, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunity, or investment, arising out of or relating to your use of, or inability to use, the Services or any information on them — even if advised of the possibility of such damages, and regardless of the legal theory.
To the fullest extent permitted by applicable law, our and Ryan Breitenbach's total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed one hundred U.S. dollars (US$100.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain liabilities; in such jurisdictions, the above exclusions and limitations apply to the maximum extent permitted by law.
6. User-contributed and third-party content
The Services may display content submitted by users or sourced from third parties, including project listings, directories, photographs, links, and other materials. We do not endorse, verify, or guarantee any such content and are not responsible or liable for it. 9. Intellectual property
The Services, including the SuperhotGeo name, logo, and original content, are owned by Ryan Breitenbach and are protected by intellectual-property laws. Photographs may be licensed from third parties (e.g., via Wikimedia Commons) and remain subject to their respective licenses and credits.
10. Changes to the Services and these Terms
We may modify, suspend, or discontinue any part of the Services at any time without notice or liability. We may update these Terms from time to time; the "Last updated" date above reflects the most recent version. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the United States and the State of the founder's principal residence, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located there, to the extent permitted by law.
12. Severability
If any provision of these Terms is held to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
